Terms of Service

Last updated September 2026

1. Who you're dealing with

This site is operated by NOMI Foods ("NOMI", "we", "us"). You can reach a person at hello@eatnomifoods.com. These Terms govern your use of nomiramen.com and any order you place through it.

2. Agreeing to these terms

By browsing the site or placing an order you agree to these Terms. If you don't agree, don't use the site. We may update these Terms; the version in force is the one posted here on the day you use the site, and we'll change the "last updated" date when we revise it. Material changes will be announced on the site or by email to subscribers.

3. Eligibility

You must be at least 18, or the age of majority where you live, to place an order. By ordering you confirm you meet that and that the payment method is yours to use.

4. Accounts

You're responsible for anything that happens under your account and for keeping your password to yourself. Tell us promptly if you think someone else has access. We can suspend or close an account we reasonably believe is being used fraudulently or in breach of these Terms.

5. Products, pricing and availability

We try to describe products accurately, but colors, packaging and photography are approximate and formulations change. The nutrition information on the pack you receive is the authoritative version. If it ever differs from the site, trust the pack and tell us so we can fix the site.

Prices are in US dollars and exclude tax and shipping unless stated. We may change prices at any time, but never for an order already placed. If a product is listed at an obviously wrong price because of a technical or human error, we may cancel the order and refund you in full rather than honor it, and we'll tell you if that happens.

All orders are an offer to buy, which we accept when we ship. We may refuse or limit an order, including where quantities suggest resale without a wholesale account.

6. Subscriptions

If you start a subscription, you authorize us to charge your payment method on the schedule shown at checkout until you cancel. We'll email you before each renewal charge with the amount and the date.

You can skip, reschedule, change flavors or cancel at any time from your account, or by emailing hello@eatnomifoods.com. Changes take effect on any order that hasn't entered fulfillment yet. There is no cancellation fee and no minimum term. If a renewal charges after you asked to cancel, tell us and we'll refund it.

7. Shipping, delivery and risk

Delivery estimates are estimates, not guarantees, and carrier delays are outside our control. Title and risk of loss pass to you on delivery to the address you gave us. If a package arrives damaged, or tracking says delivered and it isn't there, contact us within 14 days and we'll make it right.

8. Returns and refunds

Because this is food, we can't accept returns of opened product, and we can't resell unopened product once it has left our control. That means we don't offer change-of-mind returns.

We do replace or refund anything that goes wrong on our side. If an order arrives damaged, incorrect or incomplete, or if tracking says delivered and it isn't there, contact us within 14 days and we'll put it right. Nothing in this section affects any statutory right you have that can't be waived.

9. Discount codes, promotions and programs

Codes are for personal, non-commercial use, can't be resold or published to coupon aggregators, and can't be combined unless we say so. We can withdraw a code that's being abused. Program-specific terms (the Community Rate, wholesale accounts) sit on those pages and apply alongside these Terms.

10. Food safety and allergens

Read the pack before you eat it. Ingredient and allergen information is printed on every cup and is the version you should rely on. Our products are made in facilities that also handle other ingredients, and we can't guarantee the absence of cross-contact. If you have a serious allergy, check the pack and, if anything is unclear, ask us before eating it.

Store as directed. Prepared with boiling water, so take normal care.

11. Nutrition and health claims

Nothing on this site is medical or dietary advice, and NOMI is a food, not a supplement or a treatment. Statements about protein, calories, sodium and fiber describe the product; they are not claims that it will produce any particular result for you. If you're pregnant, managing a medical condition, taking medication, or on a physician-supervised program including a GLP-1, talk to your own clinician about your diet.

12. Reviews and anything else you post

When you submit a review, photo, comment or tag, you keep ownership of it and grant us a non-exclusive, worldwide, royalty-free license to use, reproduce and display it in connection with NOMI, including on this site and in marketing, with attribution to your name or handle where practical. You can ask us to stop using a specific piece of content and we will, going forward.

You promise what you post is yours to post, is honest, and isn't unlawful, defamatory, or infringing. We publish critical reviews and don't remove a review because it's negative, but we may remove content that is abusive, off-topic, fraudulent, or posted in exchange for something we didn't authorize.

13. Our intellectual property

The NOMI name, logo, packaging design, photography, copy and site design belong to us or our licensors. You may not use them commercially without written permission. Stockists get a specific, limited permission through their agreement; that permission ends when the relationship does.

14. Acceptable use

Don't scrape the site at a volume that degrades it, don't attempt to breach its security, don't resell our products as if you were an authorized retailer without a wholesale account, and don't use the site to break the law. We can suspend access for any of the above.

15. Third-party links and services

The site links to and embeds third-party services: social platforms, payment processors, shipping carriers. Their terms and privacy practices are theirs, not ours, and we aren't responsible for their content.

16. Disclaimers

The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement in relation to the site. Nothing here excludes any warranty or right that can't be excluded under applicable law, including your rights in relation to the products themselves.

17. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of your use of the site or any order is limited to the amount you paid for the order in question. We aren't liable for indirect, incidental or consequential losses. Some jurisdictions don't allow these limits, in which case they apply to the extent permitted, and nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that can't lawfully be limited.

18. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or your misuse of the site, to the extent the claim results from your own acts or omissions.

19. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules, and the courts of the State of California, United States have exclusive jurisdiction, except where the law where you live gives you the right to bring a claim locally, which it may.

Before filing anything, email hello@eatnomifoods.com. We'd genuinely rather fix it.

20. General

If any part of these Terms is unenforceable, the rest stays in force. Our not enforcing something isn't a waiver of it. You can't assign these Terms; we may assign them in connection with a sale of the business. These Terms, plus the policies linked from them, are the whole agreement between us about the site.
